Terms of Use for Desginar

Platform: The Desginar website, mobile app, and AI art generation services.

User: Any individual or entity registered to use Desginar.

Tokens: Virtual credits required to generate AI art. Free tokens are promotional; paid tokens are purchased via subscription.

Subscription: A recurring payment plan granting monthly token allocations and/or access to premium features (e.g., higher-resolution outputs).

Content: Text prompts, AI-generated images, metadata, or other materials created using the Platform.

AI Models: Machine learning algorithms trained on aggregated user-generated Content to improve Desginar's services.

By accessing or registering for Desginar, you agree to these Terms. Continued use after updates constitutes acceptance. Material changes (e.g., fee increases, and reduced user rights) will be notified via email 30 days in advance. Non-material changes are effective immediately upon posting on the Platform.

Accuracy: Provide truthful information (name, email, country). Accounts with false details may be terminated without notice.

Age Restriction: Users must be at least 13 years old. Accounts of underage users will be deleted.

Account Security: You are responsible for all activity under your account. Notify us immediately of unauthorized use at [[email protected]].

Prohibited Conduct: Account sharing, resale, or automated registration (bots) is strictly forbidden.

Free Tokens:

Granted upon registration (3 tokens).

Expires after 30 days of account inactivity (no logins or token usage).

Referral Program: Inviter receives 2 tokens; invitee receives 1 token after the invitee completes registration and uses their first token.

Tokens are non-transferable, non-refundable, and have no cash value.

Paid Tokens: Acquired via subscription. Unused tokens expire 30 days after subscription cancellation.

Auto-Renewal: Subscriptions renew every 30 days unless canceled at least 24 hours before the billing cycle ends.

Price Changes: Users receive email notice 30 days before increases. Continued use after the price change constitutes acceptance.

Payment Failures: After 3 consecutive failed payment attempts, subscription access is suspended until payment is updated.

Refunds: No refunds for unused tokens or partial subscription periods.

Cancellation: Users may cancel via their account dashboard. Cancellations take effect at the end of the current billing cycle.

Free Token Content

Paid Token Content

Publicly displayed in the Desginar gallery. Private by default.

License: Desginar holds a non-exclusive, perpetual, worldwide license to use, modify, and display Content for marketing, training AI models, or promotional purposes.

Anonymization: All Content (free/paid) is stripped of personal identifiers (e.g., user ID, IP address) before being used to train AI models.

Aggregation: Data is combined with other users' Content to ensure it cannot be traced back to individuals.

Opt-Out: Paid subscribers may email [[email protected]] to exclude their Content from future AI training.

You agree not to use Desginar to:

Generate Content that violates laws (e.g., defamation, terrorism, child exploitation).

Promote hate speech, racism, or violence against individuals/groups.

Contain adult material (e.g., nudity, explicit sexual content).

Reverse-engineer, decompile, or exploit vulnerabilities in the AI models.

Spam other users, distribute malware, or engage in phishing.

Impersonate others or infringe intellectual property (see Community Guidelines).

Legal Compliance: Ensure Content complies with laws in your jurisdiction.

Content Review: AI outputs may be inaccurate or offensive. Review all Content before public use.

By Desginar: We may suspend or terminate accounts for violations (e.g., hate speech, fraud, spam).

Appeals: Submit a written appeal to [[email protected]] within 14 days of termination.

Effect of Termination: Unused tokens and subscription fees are forfeited.

AI Limitations: Generated Content may contain errors, biases, or inaccuracies. Use at your own risk.

No Warranty: The Platform is provided "as is." Desginar disclaims warranties of merchantability, fitness for purpose, or non-infringement.

Liability Cap: Desginar's total liability for claims shall not exceed the amount paid by the user in the past 6 months.
